This Privacy Policy explains how Kraken (“Kraken”, “we”, “us”) collects, uses, shares, and protects personal information when you use the Kraken mobile applications, websites, and related logistics, delivery, and ride services in Libya.

1. Information we collect

• Account data: name, phone number, email, password hash, profile photo, and account role (customer, driver, store).
• Orders, shipments, and rides: pickup/drop-off addresses, cargo description, trip details, payment status, ratings, and support messages.
• Location data: precise GPS and/or approximate network location, as described below.
• Device and usage data: device model, OS, app version, language, crash/diagnostic logs, and IP address when you use the service.
• Driver documents: vehicle and identity documents you upload for verification.

2. Location data — collection, use, and sharing

Customers

We access location while you use the app to pick a map pin, estimate distance, find nearby drivers or stores, and show your position on a map. This is foreground / while-in-use location. We do not track customers in the background when the app is closed.

Drivers

When you turn Online or accept a trip, Kraken collects precise location to:

• show your live position to customers on the map so they can choose you or send a ride request;
• match nearby ride and delivery requests to your actual position;
• share your live position with the customer during an active trip for ETA and safety;
• continue those updates when the app is in the background, the screen is locked, or the app is not in the foreground, using Android “Allow all the time” / ACCESS_BACKGROUND_LOCATION and a persistent notification.

Location sharing stops when you go Offline, finish the trip, or stop tracking from the in-app / notification control. We do not collect driver location while you are Offline.

Sharing: live coordinates are sent to Kraken servers and shown to the relevant customer (and operational staff as needed to fulfill the trip). We do not sell location data or use it for third-party advertising.

3. How we use information

• Create and manage accounts; process orders, deliveries, and rides.
• Calculate pricing, ETAs, and driver–customer matching.
• Send service notifications (order status, ride updates, security).
• Fraud prevention, safety, dispute handling, tax and legal compliance.
• Improve reliability and customer support.

4. Sharing of information

• With the other party to a trip or order (customer ↔ driver ↔ store) as needed to fulfill the service.
• With infrastructure providers (hosting, messaging, maps, analytics) under processing terms.
• With authorities when required by law or to protect safety and platform integrity.
• We do not sell personal information.

5. Permissions

• Location: as described in section 2.
• Camera / photos: only when you upload images (profile, documents, proof of delivery, support).
• Notifications: order, ride, and account alerts.
• You can change permissions in device settings. Some features will not work without them.

6. Retention

We keep personal data as long as needed to provide the service and for legal, tax, dispute, fraud, and security purposes. Trip location history may be retained for safety and dispute resolution. When data is no longer required, we delete or anonymize it where reasonably possible.

7. Security

We use HTTPS, access controls, and operational safeguards. No method of transmission or storage is 100% secure.

8. Your rights

You may request access, correction, deletion, or restriction of your personal data where applicable by law, and you may request account deletion via in-app support or privacy@kraken.ly, subject to legal and operational requirements.

9. Children

The service is not directed at children under 13. We do not knowingly collect their data.

10. International processing

Data may be processed on servers or by providers outside Libya. We apply reasonable safeguards consistent with applicable law.

11. Changes

We may update this policy. The updated text will be posted on this page with a new date. Continued use after the update constitutes acceptance of the revised policy.
